What is Occupational Safety and Health Legal Compliance Assessment ?

It is an assessment which evaluates your business compliance level against the two primary Malaysian safety and health legislations namely Occupational Safety and Health Act 1994 (OSHA 1994) and Factories and Machinery Act 1967 (FMA 1967)

Is it Important ?

As long as your business remains operated in Malaysia, it is mandatory to comply with the legislations. Any non-compliance to these legislations may risk you to fine(s) or imprisonment or to both. The Department of Occupational Safety and Health (DOSH) Malaysia is well-known for their strict measures against occupational safety and health offenders. Most importantly, in 2022 the penalties have been increased up to RM 500,000.00.

How to Comply ?

Compliance to the legislations is relatively easy. You only need commitment and perseverance to the safety and health matters that arises from your business. You can start by identifying the applicability of each of the regulations to your business. Then, prepare a checklist for each of the regulation to cross-check with your daily operations. Document your findings and table it out in the management meeting. Prepare the necessary action plan according to your findings. Lastly, close the findings in a timely manner.

Who is eligible for the Free services?

The Free services have been designed to assist Small and Medium Enterprises (SMEs) especially those who are without dedicated Safety and Health personnel.

Note: OCCUPATIONAL SAFETY AND HEALTH (AMENDMENT) ACT 2022 requires employers who employ 5 or more workers should appoint one of the workers as Occupational Safety and Health Coordinator.

Is it really Free?

The Free OSH Legal Compliance Assessment and Free ISO 45001 Management System Gap Analysis are two free services as their names suggest. However, if any of the services is to be performed in area outside of Klang Valley, travelling and accommodation charges will be imposed.

I have many branches and sites. Can you conduct the Free services at all of them?

No. The Free services only applicable to only one site or branch per company/parent company.

However, we may provide our Standard OSH Legal Compliance Assessment service at our standard industry charge rate. To get Free quote on the Standard OSH Legal Compliance Assessment, email to azam@amiosh.com.

Will you inspect and check all plant and machineries in my site?

We may or may not conduct entire plant and machinery assessment during the Free service. However, we may request for proof of your compliance by assessing on-site implementation.

If you require us to assess your entire plant and machineries, the services are provided under our Standard OSH Legal Compliance Assessment.

Is there any report after the Free assessment?

There will not be any official report provided. However, we may provide a checklist report in 48 hours after the assessment has been carried out.

After the legal compliance assessment has been conducted, am I going to be 'safe' against any DOSH/JKKP actions?

We do not control or impose what DOSH/JKKP do to the industries or organizations under their purview. However, after the Free assessment, you will have the information on the actions to be taken by your organization in order to comply with the applicable legislations.

For example, in the case of use of hazardous chemicals at site we will recommend you to conduct a Chemical Health Risk Assessment (CHRA) to the workers related to the use and handling of such chemicals, only if during our assessment the CHRA report is not found.

Do you cover all Safety, Health and Environment legislations under the Free services?

We impose maximum time spent on client site which is of not more than 2 hours, therefore not all clauses from the legislations can be covered.

Select clauses from the following legislations will be covered:

Occupational Safety and Health Act 1994 (Main),
Occupational Safety and Health (Use and Standards of Exposure of Chemicals Hazardous to Health) Regulations 2000,
Noise Exposure Regulations 2019,
Factories and Machinery Act 1967 (Main),
Factories and Machinery (Safety, Health & Welfare) 1970, &
Environmental Quality Act 1974 (Main)

However, under our standard OSH Legal Compliance Assessment, we will cover all clause in detail.

What are the differences between Free OSH Legal Compliance Assessment and Free ISO 45001 MS Gap Analysis?

Compliance to Safety, Health and Environment legislations is mandatory for organizations operating in Malaysia. Meanwhile, conformance to Occupational Health and Safety ISO 45001:2018 Management Systems is totally voluntary and subject to your Client's requirements and needs if any.
